Terms of Service

 

1.       Welcome to Homeshapers. These Terms and Conditions apply to the use, all policies and conditions associated with this website. By accessing this website and/or placing an order, including orders made over the phone, you agree to be legally bound by the Terms and Conditions set below. Homeshapers at its discretion, may change or modify these Terms & Conditions.

General Terms

2. the Buyer must be at least 18 years of age.

3.       Legally capable of entering into binding contracts.

4.       All information that you have provided; your name, payment details, delivery address, email address & telephone number are genuine.

5.       Homeshapers only deals within UK mainland. We reserve the right to decline orders from residents outside the UK.

How the Contract Is Formed Between us and the Buyer:

6. once the Order is placed, the buyer will receive confirmation by email. ‘Order confirmation’ is acknowledgement that we have received your order/ payment and have begun to process your order.

7.       Order can be processed on the website, over the phone or in store.

8.       Buyer should be aware that once order has been accepted, an email or receipt of order received is a legally binding contract.

Your Statutory Right To Cancel:

9.  After placing your order you have a 24 hours cooling off period to cancel your order. once the 24 hour cooling off period has exceeded, your order cannot be changed or cancelled (Read clause 19).

10. if you are not happy with your purchase and wish to return your bed once delivered, it may be possible at managers discretion to exchange the bed to the value however, this will incur in a handling fee of £150 to cover the delivery charges.

11.   To cancel an order the buyer should contact us via Email or by Telephone.

12.   If the order is cancelled, we will refund the value of of products within 14 days (Clause 9).

13.   Refund will only be given on original payment method - no exception will be made.

14.   Any Delivery charges incurred will not be refunded.

15.   Any Courier charges may apply.

16.   Any orders cancelled 24 hours prior to dispatch, no charges will incur.

Buyer’s liability:

17.   We do not take any responsibility if:

18.   the Buyer has made an error with the dimensions of the bed, the size, colour and design.

18.1 if any of the above are valid then we wont be able to exchange your bed however alternatives can be offered.

19.   Any customised products such as different designs, size, colour or features of the product .

20.   Choosing your mattress with your specifications or through images.

21.   All these terms apply with clause no 9, 26 and 27.

Cancellation by Us/deposits:

22.   We reserve the right not to accept any order if:

23.   We have insufficient stock to deliver the goods.

24.   We do not deliver to your area.

25.   One or more of the products ordered was incorrectly described or priced on the website.

26.   Payment is not authorised.

27.   Any type of partial deposit for your order is non refundable if you choose to cancel your order after the 7 days period or return the product at a later date.

28.   No refunds can be authorised on mattresses that have been opened from their original packaging.

29.   If order is cancelled - Refund will be given within 14 days. We will not be obliged to offer any additional compensation.

Faulty/ Damaged Goods:

Please note: the damaged items can only be recognised as damaged goods if the goods are dirty, ripped or scattered. Minor scuffs on the fabric will not be recognised as a damaged item.

30. If products received are faulty, damaged or not as described, the Buyer is required to:

31.   Notify the Seller of the damaged/faulty goods within 72 hours of receiving the products.

31.1. After the 72 hours period, seller is not liable to replace any damaged parts or faulty products.

32.   Provide photographic evidence of the fault/damage to the seller.

33.   Provided the Buyer has adhered to the above clauses, the Seller will replace the damaged/faulty products within 1-10 working days of evidence being received, unless of any reasons beyond the control of the buyeR.

33.1. If the buyer starts to use the product in any case, the seller is not responsible for any replacement or exchanges but in this case a partial refund can be offered to the buyer at managers discretion.

33.2 IF the buyer has assembled the bed then we wont be able to offer any return or exchange

Delivery:

34.   All products ordered will be delivered to the address specified by the Buyer.

35.   The Buyer is responsible for receiving the goods at the given address.

36.   All deliveries must be signed for by the Buyer or Person authorised to accept delivery.

37.   Delivery dates are approximations only - standard delivery time is 14 working days. In some cases this can take 21 days.

38.   All Homeshapers and Third party Delivery drivers are only permitted to deliver products to the door.

39. If your delivery is handled by third party couriers, Homeshapers is not responsible for any delays or any unforeseen circumstances.

40. If you are living in a flat or apartment, The third party couriers will not be responsible to bring the bed upstairs to your door. THere is a surcharge of £20 to request this service after or before placing your order.

40.1 It is the customers responsibility to request this service with our staff.

41.   If the Buyer fails to accept delivery, the Seller reserves the right to charge the Buyer to cover the cost of the failed delivery.

42.   We do not accept any blame or liability for customers removing or disposing of old goods - we advise to only dispose of any old goods after the delivery of the new goods.

43.   Deliveries made to business addresses will have the Buyers authority for anybody in the building to accept goods on the Buyers behalf.

44.   The Seller accepts no responsibility once goods have been signed for at the requested address.

45.   Homeshapers & third party drivers will not assemble any orders. The assembly is the responsibility of the Buyer.

Assembly:

46. Homeshapers CAN PROVIDE A THIRD PARTY ASSEMBLY SERVICE UPON REQUEST.

47. THIS SERVICE IS SOLELY BETWEEN THE CUSTOMER & THE COURIER TEAM. Homeshapers WILL NOT BE RESPONSIBLE FOR ANY INCONVENIENCE CAUSED BY THE COURIERS.

48. THIS SERVICE IS HELD AND DELIVERED WITH CARE WITH A PROFESSIONAL ASSEMBLERS & THE BED IS LIFTED TO THE CHOICE OF YOUR ROOM WHERE ASSEMBLY WILL BE CARRIED OUT.

49. THERE IS A SURCHARGE OF £50 TO REQUEST THIS SERVICE EITHER AT THE TIME OF ORDERING OR BEFORE YOUR DISPATCH.

50. THE PAYMENT OF £50 NEEDS TO BE PRE-PAID TO homehspaers BUSINESS ACCOUNT.

51. IF ANY ISSUES OCCUR AT THE TIME OF ASSEMBLY, Homeshapers IS NOT RESPONSIBLE FOR ANY DAMAGES AT THE TIME OF ASSEMBLY FOR EXAMPLE WHILE MAKING THE BED OR ANY OTHER DAMAGES.

52. IT IS the CUSTOMERS RESPONSIBILITY TO CHECK THIER ITEM CLOSELY ONCE ASSEMBLED and if any issues occur the customer would need to make the assemblers aware OF THE SITUATION STRAIGHT away at tHe time of assembly.

53. If the customer does not check thier item and let the courier team aware after a delayed time. Homeshapers will not be able to help or raise this complaint with the couriers.

54. Once the issue has been notified by the customer to the couriers, homeshapers will act on behalf of your complaint and try to offer a resolution however homeshapers can only act on behalf of the customer IF the complaint was logged IN AT THE TIME OF THE ASSEMBLY.

55. REMOVING THE PACKAGING WILL NOT INCLUDE IN THIS ASSEMBLY SERVICE & ASSEMBLERS ARE NOT LIABLE TO REMOVE OR BIN YOUR PACKAGING UNLESS YOU DEAL WITH THEM DIRECTLY.

56. ANY COMMunication between you and assembler is between both parties or if you agree to any arrangements this is entirely your responsibility however homehspapers will not be responsible for such arrangements.

Payment:

55.   The Seller accepts most major credit cards including Visa, MasterCard and American Express.

56.   By using American express, seller will incur a charge of 2.5%.

57.   When ordering, the Buyer must provide their exact billing address. Incorrect information will cause a delay in processing the order.

58.   An order will only be processed once the Seller receives full payment from the Buyer.

59.   If the Seller makes an error in the confirmation or any invoice or receipt, the Seller will correct that error within 72 Hours of being notified by the Buyer.

60.   Homeshpapers Retains the right to investigate any order placed that it suspects to be fraudulent - Any such order will not be delivered until it is proven to be authentic.
